LAST MINUTE SURPRISES FOR APRIL 15




April 15 is only about three (3) weeks away and just like last year, when totally new income tax return (ITR) forms were suddenly released and mandated for use by the BIR, taxpayers once again received some last-minute surprises before this year's ITR filing deadline. 

Just this March, the BIR issued two (2) new revenue regulations (RRs) that prescribe new requirements for large and small taxpayers and both RRs will greatly impact on affected taxpayers during this year's ITR filing season. 

One of these regulations, RR 2-2015, involves the requirement for digitized submission of certificates of taxes withheld (CTWs) to be claimed as tax credit by large taxpayers against their income tax payable. This new requirement took effect last March 21, 2015.

While large taxpayers would normally welcome the submission of documents in digital format, this is not the case for RR 2-2015. With this new rule, large taxpayers will have to manually scan each of the hundreds and even thousands of certificates that they receive from customers, arrange each one of them with a specific file name format, and submit the files via DVD to the BIR. 

With this new requirement, BIR personnel will avoid receiving and stamping truckloads of CTWs during the filing season. However, the requirement for scanned files will definitely result to additional work and costs on the part of large taxpayers, not to mention the fact that they still need to maintain the hard copy of all those certificates in the event of BIR audit.   

Meanwhile, another new regulation, RR 5-2015, mandates certain types of taxpayers to file their returns using the BIR's eBIR forms facility. These include those with "No Payment" returns and One Time Transaction (ONETT) taxpayers, among others. Under this new rule, taxpayers who fail to comply will be imposed a penalty of P1,000 per return and additional civil penalty of 25% of the tax due. 

With this new regulation, the BIR hopes to facilitate the electronic submission of tax returns and minimize the manual filing at the BIR offices. However, while this is envisioned to make it more convenient for taxpayers to file their tax returns, the new regulation provides that it shall take effect immediately, despite the fact that the RR was only issued last March 17, 2015 (although an initial regulation, RR 6-2014, was already issued in 2014).

In both cases, the BIR mandated these new rules with less than a month to go before April 15. Many affected taxpayers are now at a loss on how to best comply with the new tax filing requirements, aside from encountering certain technical difficulties and raising certain practical issues along the way. 

Unfortunately, the BIR has confirmed that these new rules will already apply in time for the April 15 ITR filing for taxable year 2014. It is made even worse for affected individual taxpayers, who also need to file their 1st Quarter ITRs on April 15.

While it is important that the BIR is able to capture tax information in a timely and efficient manner, especially through electronic means, let us not forget that one of the most basic taxpayer rights is the right to be informed, assisted and heard. 


It is very important for for taxpayers to properly understand new tax rules with sufficient lead time for taxpayer education and cascade of information. This becomes even more important considering that public hearings are no longer conducted by the BIR prior to the issuance of new regulations, unlike before. 


Taxpayers should be given sufficient time to adjust their systems and processes so that they can best comply with the new tax filing requirements. The BIR should also have more than enough lead time to properly conduct a tax information campaign among taxpayers and hear out various taxpayer concerns.  

Given this, we need to appeal to the BIR to defer the implementation of these new regulations until after this April 15 tax filing season. At the very least, these should be made optional at this point, rather than mandatory.  

Otherwise, giving Filipino taxpayers less than a month before April 15 to prepare and comply with these new tax regulations is like setting them up for failure.

    1. Hi, Melba. Large taxpayers usually are top corporations notified by the BIR as such. They qualify based on certain criteria, like gross sales, VAT, etc.

    1. It now appears that ALL taxpayers, who are not under the electronic filing and payment system (EFPS) of the BIR, would have to use eBIR forms in their tax filing/payment. Pre-printed forms or forms in PDF/Excel file are no longer allowed.

      However, please note that there is distinction between those who are MANDATED to use the online eBIR forms facility (electronic filing) and those who are NOT MANDATED but would have to use the offline eBIR forms package. Those mandated to do the electronic filing are as follows:
      1. Accredited Tax Agents/Practitioners and all its client-taxpayers;
      2. Accredited Printers of Principal and Supplementary Receipts/Invoices;
      3. One-Time Transaction (ONETT) taxpayers;
      4. Those who shall file a "No Payment" Return;
      5. Government-Owned or -Controlled Corporations (GOCCs);
      6. Local Government Units (LGUs), except barangays; and
      7. Cooperatives registered with National Electrification Administration (NEA) and Local Water Utilities Administration (LWUA).

    2. Thank you for your reply. However, I still do not understand fully - what is the difference between those who are mandated to use the online eBIR forms and those who are NOT mandated, if ALL taxpayers not under the EFPS would have to use eBIR forms anyway?

    3. Hi Giselle. EFPS is a system for large taxpayers and the top taxpayers. All others would now fall under the eBIR forms system. Under eBIR forms, there are 2 types - online and offline. Their only difference is that online would entail electronic filing while, offline would entail printing out the forms for filing. In any case, it appears that all taxpayers would have to do their ITR preparation with the use of a computer to encode their tax data, be it under EFPS and under eBIR forms.     1. hi! if no payment, then you are required to do the electronic filing (using online eBIR forms facility) and wait for the BIR-issued filing reference number via email as proof. no need to go anymore to the RDO. however, electronic filing requires online registration with the BIR. the BIR will issue you a password via email before you can do the electronic filing. suggest you register early to avoid the rush.

    2. Hi Rina! Just to clarify, for "No Payment Return" 1701 I would have to file it from Offline eBIRForms to Online eBIRForms. How about for 2551M and 1701Q with payment? Do I also have to submit them online? I have paid for my 2551M and 1701Q yesterday through AAB using the Offline eBIRforms without the FRN or submitting them first online.     I'm under an agency with Zero-Rating PEZA Certification and they said that I need to file 2550M and 2550Q respectively. The BIR Branch where I registered my documents said that I need to go to BIR Main Office to apply for the zero-rating exemption. This doesn't make any sense to me since I already have the certification.

    I hope you can enlighten me on this matter. Thanks.

    1. Hi, Jenny. As VAT zero-rated taxpayer, you are still required to file your VAT returns. If you'd like your suppliers not to pass on to you the 12% VAT on your purchases from them, the PEZA certification should suffice as proof. Hope this helps. Thanks.

    2. I just started the contractor/consultancy services this year, January 2015. Do I need to file anything? As far as I know, I am only required to file 2550M and 2550Q but BIR San Pablo branch is not honoring the PEZA Certificate I'm presenting. They said I need to register/apply the non-payment filing to BIR Main Office. Thanks for responding...

    1. hi, shone. manual filing of offline eBIR forms are allowed. you can check out the march 26 blog post. also, the BIR just issued a new circular yesterday which again allows the manual filing of PRE-PRINTED BIR forms for senior citizens, salaried workers with taxes fully withheld by employers, and those who opt to file ITRs for promotion, travel document, etc (see new blog post today, march 31).

  8. How can we possibly submit online if this is the case? We've been trying to submit online since Jan 2015, however, up to this date, when we click the Submit button, it says "eBIRForms Offline to eBIRForms Online is still under construction."

  12. medyo confusing lang. does this mean na lahat are mandatorily required to file online? There is a circular prescribing non efps filers to file submit and pay thru efps facility. rr6-2014

  13. hi rina..nag try kame mag submit ng offline ebir to online ebir form ng 1701 kaya lang under construction daw..pero nag try kami mag submit 2551m at nag connect naman xa sa online ebir form..is it possible na hindi pa talaga ready ang online ebir form submission para sa 1701?

  15. hi rina, do I have to register before using ebirform offline and online? where and how do i do that. Filing 1701 for my 84 y/o mother, was able to fill out 1701 using ebirform offline but once you try to submit, online is under construction. Can I still file this at RDO?

    1. hi! for your 84 year-old mother, you can use any of the ff: offline eBIR forms, BIR pre-printed forms, or PDF/Excel computer-generated form, and print them out for filing with the RDO. please see most recent blog post dated march 30 for update.

  16. hi rina, one more question pls. Re 1701Q, is it also mandatory to use their "e" facility for this? Since there is payment required, can I still go to Land bank to pay?

    1. based on the BIR's new rules, all non-EFPS taxpayers will have to use the eBIR forms facility. since you have payment, you can use the offline eBIR forms, print it out and pay with Landbank.

  17. Hi Ms. Rina, I have filed both the 1701Q and 2551M on the online ebirforms already. In order to use it, you have to SIGN UP first and fill out the necessary information that are needed. As I've noticed, you don't need to go to your RDO to activate your account. A day after you signed up (or hours after in my case), they will send you already your temporary PW and Username. After that, you can log in to the ONLINE ebirforms and change the PW as the system requires it to. It is important also to know that the OFFLINE PACKAGE that will be used to SUBMIT the forms to ONLINE must be the latest version, specifically VERSION 4.7.06. Hence, the 1701 is still under construction. I hope this could help!

Thankfully, I don't have to go to the RDO anymore as per their first email instruction in order to activate the account. However, whenever I try to submit my 1701 I still get this message, "eBIRForms Offline to eBIRForms Online is under construction." Just to clarify, it might be because of the version of the offline package that's why it keeps on prompting 'ebir online is under reconstruction' when i try to submit the ITR that I had already submitted manually (before holy week but they did not ask me anything about any codes/confirmation during the time I submitted)? Thank you! plus for the percentage tax, is online submission required before i go to the bank and pay?

    Where/how do we get/generate the xml format of tax returns to be uploaded to the online submission? Because when I uploaded the xml file generated from the offline ebir form, the online system remarked the file as error file.

    2. Hi Francisco, try to download the latest version of OFFLINE PACKAGE (4.7.06). Prior versions won't work as those were not supported maybe by their updates with ONLINE eBIRForms website.:)

    3. I tried submiting/uploading the xml file on the website too, it resulted in an error as well.

      They have a newer version, 4.7.08

      Maybe I shall try submitting again using the offline software (because it failed too when I tried using the latest ver 4.7.08 :( )

  21. seryoso ba yan na kapag hindi mo ifile online eh magpenalty talaga yan??????? paano nila yan mapapanagot lahat ng hindi susunod jan iisa isahin ba nila yan???????? kasi andami na hindi naman nagfile online eh.. nagsubmit lang sila dun sa rdo.. eh sa rmc 14-2015 kahit magfile ka manual dapat ifile mo pa rin online... baka tayo heto dumudugo na mga utak natin sa kapipilit maipasok mga itr natin online.. tapos joketime pala sila :(

  22. hi mam rina. need po ba talaga i-TIN verify pa ang mga bir forms bago mabayaran even meron ng FRN from the online ebirform? kasi bumalik kami sa hassle ng pagpunta at pagpila sa bir pra magpa-TIN verify bago makapagbayad dahil din na rin nila tinatanggap yung previously issued nila na permanent TIN verification.

    also, may mga sign-up po sa online ebirform na hanggang ngayon ay wala yung email ng activation where we can see the username at initial password. nag-sign up po sila ay april 1 pa. nagfollow-up na sa bir ang sagot "hintayin nyo lang darating yun...." now is april 12, 2 days na lang at due na ng itr, wala pa rin :( di naman makapagre-sign up kasi ang error prompt ay with pending application na.

  23. As a self-employed individual (professional), I have been filing my monthly/qtrly VAT using the offline eBIR package, printing my forms and then paying through the bank. RR#6-2014 and RR#5-2015 mandate electronic submission/filing only for "those who file a no-payment return" and "accredited tax agents/practitioners AND ALL ITS CLIENT-TAXPAYERS" --- neither of which apply to me because my filings have payments and I do not use any accredited tax agent/practitioner (as I file my own returns). Am I mandated now to electronically file/submit my 2550M and 2550Q even if WITH PAYMENT? Or am I mandated to electronically file only the 1701 as well as my 1701 Q (for the first quarter 2015 --- due this April 15) even if with payment? Thank you in advance for clarifying the VAT vs ITR situations as I am quite confused with what I have been hearing...

  25. The ebirforms portal still has issues. June 15 is only a few days from now. Should the Filipino taxpayers be penalized because of the incompetence of the BIR? Tapos kailangan pa ng Internet Explorer 9 to use the system daw? Anong year kaya ang nasa kalendaryo ng BIR? Palibhasa yung milyones na halaga nilang computers ay naka IE9 pa so ang akala nila lahat ng Filipinos naka Windows 7 p? Lalabas na nga ang Windows 10 at Spartan browser eh.

    Another thing, yung recently changed password ko sa portal ayaw pang tangapin. Invalid daw. Hindi rin naman makapagchange ng password. Three times na akong nagemail sa kanila, wala pang reply. Hindi rin ako maconnect sa CS nila at always busy. Sobrang dami ba ang nagrereklamo? I read in one forum na kailangan daw pumunta sa national office sa IT department mismo para maayos. I live in Baguio city. Do they expect every Filipino in every corner of the Philippines to physically be in Quezon City para lang maayos ang login information nila? Tapos yung instructions pa sa Subject ng email para sa temporary filing iba sa Memorandum at iba ang nasa email reply. Ano ang susundin namin dito? Kasi kapag mali daw ang subject, ididsregard. Baka napenalized na ako, hindi ko pa alam.

    Wala bang petition para mabasura tong kalokohan na to or madelay man lang ng ilang years kung kailan kaya na ng system nila at may organization na? Bakit parang walang ginagawa ang mga leaders/senado/congreso/presidente/supreme court natin tungkol dito? Natatakot ba silang paimbestigahan ni Henares? Marami akong nakita sa local BIR office namin ngayon na hindi pa rin alam kung anong gagawin nila. Mukhang extrang pera lang yata ang gusto ni Henares dito kasi sigurado ko maraming mapepenalized kung hindi irereverse ito. Yung panghulog ko ng sasakyan mapupunta lang kay Henares dahil sa inaasahan kong multa. Tapos magrereport si Henares na tumaas ang tax collection for this year. Hay Lord. Please help us!

  29. hello po! paano po gagawin sa naka receive kana ng FINAL COPY and receieve a confirmation receipt tapos my gusto po ako baguhin don, gaya po nung kunwari yong rentals ko na sa cost of sales ko dapat ilalagay sa ordinary allowable deductions ko po nalagay, at yong sa BS po nagka typo error po.. I mean napilit ung pagbalance po. 1701-ITR.. paano po gagawin doon? Please I need reply asap.
